当社では、お客様からのご依頼によって国内の受注型企画旅行を行う場合、本条件書の規定によってお引き受けいたします。
この内容（国内受注型企画旅行条件書）は旅行業法第12条の4に定める「取引条件説明書面」及び同法第12条の5に定める「契約書面」の一部となります。ご旅行の申し込み前に、必ずこの内容と旅行詳細をよくお読みのうえ、お手続きください。
Note: This section constitutes a part of the official “Explanation of Terms and Conditions” under Article 12-4, and the “Contract Document” under Article 12-5 of the Travel Agency Act. Please ensure you review these terms and your itinerary details thoroughly before completing your booking.
1.受注型企画旅行契約
「受注型企画旅行契約」（以下「契約」といいます。）とは、当社がお客様（以下、契約責任者および構成者を総称して「お客様」といいます。）の依頼により、旅行の目的地及び日程、運送・宿泊等の旅行サービスの内容、並びに旅行代金の額を定めた計画（企画）を作成し、これにより旅行を実施する旅行契約をいいます。
A “Customized Package Tour Contract” (hereinafter referred to as the “Contract”) is a travel contract in which our company, at the request of the customer (hereinafter, the contract manager and members are collectively referred to as the “Customer”), creates a plan (proposal) that specifies the destination and itinerary of the trip, the content of travel services such as transportation and accommodation, and the amount of the travel price, and then carries out the trip accordingly.
2.契約の申込みと参加条件
- 当社が提示した企画内容に申し込もうとするお客様は、当社所定の申込書に必要事項を記入の上、当社が別に定める申込金を添えて提出していただきます。
Customers wishing to apply for the program offered by our company must fill out the required information on our designated application form and submit it along with the application fee separately determined by our company. - 当社と通信契約を締結しようとするお客様は、前項の規定にかかわらず、申込書の提出に代えて会員番号等を通知しなければなりません。
Notwithstanding the provisions of the preceding paragraph, customers who wish to enter into a communication contract with our company must notify us of their membership number, etc., instead of submitting an application form. - 旅行開始時点で15歳未満の方は、原則として保護者の同行が必要です。また、特に注釈のない限り、満12歳以上は「おとな代金」、満6歳以上12歳未満は「こども代金」、航空機利用コースの満3歳以上6歳未満は「幼児代金」を適用します。いずれも旅行開始日当日を基準とします。
As a general rule, travelers under 15 years of age at the start of their trip must be accompanied by a guardian. Unless otherwise noted, the following fares apply: “adult fare” for those 12 years of age and older, “child fare” for those 6 to under 12 years of age, and “infant fare” for those 3 to under 6 years of age on air travel packages. All fares are based on the date of departure. - 心身に障がいのある方、食物・動物アレルギーのある方、妊娠中の方、その他特別な配慮を必要とする方は、お申込み時にその旨をお申し出ください。当社は可能かつ合理的な範囲内でこれに応じます。なお、特別な措置に要した費用は原則としてお客様の負担となります。現地事情等により安全な実施が困難と判断した場合は、同行者の同伴や医師の診断書の提出を条件とするか、お申込みをお断りすることがあります。
If you have a physical or mental disability, food or animal allergies, are pregnant, or require any other special considerations, please inform us when you apply. We will accommodate your needs to the extent possible and reasonable. Please note that, in principle, the costs incurred for special accommodations will be borne by the customer. If we determine that it is difficult to conduct the tour safely due to local circumstances, we may require you to be accompanied by a companion or submit a doctor’s certificate, or we may decline your application. - 当社は、団体・グループの代表者（契約責任者）から申し込みがあった場合、一切の代理権が契約責任者にあるものとみなします。契約責任者は、当社が定める日までに構成者名簿を提出しなければなりません。契約責任者が同行しない場合、旅行開始後はあらかじめ選任された構成者を契約責任者とみなします。
When an application is made by the representative (contracting officer) of an organization or group, we will consider that the contracting officer has full authority to act on behalf of the group. The contracting officer must submit a list of group members by the date specified by our company. If the contracting officer does not accompany the group, a pre-designated member will be considered the contracting officer after the start of the trip. - 旅行中のお客様都合による別行動は原則としてできません。お客様の不注意により集合時間に遅れ、捜索活動が必要となった場合の捜索経費等は、全額お客様の負担となります。
As a general rule, separate activities due to customer preference during the trip are not permitted. If a customer is late for the meeting time due to their own negligence and a search operation becomes necessary, all search and rescue expenses will be borne entirely by the customer.
3.契約締結の拒否・反社会的勢力の排除
当社は、次に掲げる場合においては、受注型企画旅行契約の締結に応じないことがあります。
Our company may refuse to enter into a customized package tour contract in the following cases:
- 当社の業務上の都合があるとき。
When it is necessary for our company’s operations. - 通信契約を締結しようとする場合であって、お客様がお持ちのクレジットカードが無効である等、旅行代金に係る債務の一部又は全部を提携会社のカード会員規約に従って決済できないとき。
When attempting to enter into a communication contract, if the customer’s credit card is invalid or for other reasons, and part or all of the debt related to the travel expenses cannot be settled in accordance with the affiliated company’s cardholder agreement. - お客様が他のお客様に迷惑を及ぼし、又は団体行動の円滑な実施を妨げるおそれがあるとき。
When a customer may cause inconvenience to other customers or hinder the smooth conduct of group activities. - お客様が暴力団、反社会的勢力、またはこれらに準ずる者であると認められるとき。
When a customer is found to be a member of an organized crime group, an anti-social force, or a person equivalent thereto. - お客様が当社に対して暴力的な要求、脅迫的な言動、風説の流布、または業務妨害行為を行ったとき。
When a customer makes violent demands, engages in threatening behavior, spreads rumors, or obstructs our business operations.
4.契約の成立時期
- 契約は、当社が契約の締結を承諾し、申込金を受理した時に成立します。申込金は、旅行代金、取消料、または違約料の一部または全部に充当します。
The contract is concluded when our company accepts the conclusion of the contract and receives the application fee. The application fee will be applied to part or all of the travel price, cancellation fee, or penalty fee. - 申込金の支払いを受けることなく契約を締結する特約を結んだ場合は、当該特約書面を交付したときに契約が成立します。
If a special agreement is made to conclude a contract without receiving a deposit, the contract will be concluded when the document outlining that special agreement is delivered. - 通信契約は、前2項の規定にかかわらず、当社がお申し込みを承諾する旨の通知を発し、当該通知がお客様に到達した時に成立します。
Notwithstanding the provisions of the preceding two paragraphs, a communication contract is concluded when we issue a notice of acceptance of your application and that notice reaches you.
5.契約書面と確定書面（最終日程表）の交付
- 当社は、契約成立後速やかに、旅行日程、サービス内容、旅行代金、当社の責任等を記載した契約書面（企画書面、本旅行条件書等）を交付します。
After the contract is concluded, we will promptly provide you with a contract document (such as a travel plan or these travel terms and conditions) that outlines the travel itinerary, services provided, travel price, and our responsibilities. - 契約書面において、確定された旅行日程や利用機関名が記載できない場合は、利用予定の範囲を限定して列挙した上で、旅行開始日の前日（間際のお申し込みの場合は旅行開始日）までに、確定状況を記載した「確定書面（最終旅行日程表）」を交付します。
If the finalized travel itinerary and names of the service providers cannot be included in the contract document, we will list the planned services to a limited extent and provide a “Confirmation Document (Final Travel Itinerary)” detailing the finalized status by the day before the travel start date (or the travel start date in the case of last-minute bookings).
6.旅行代金の変更、及び含まれないもの
- 旅行代金は、旅行出発日までの当社が定める期日までにお支払いください。
Please pay the tour fee by the deadline set by our company before the departure date of your trip. - 通信契約を締結した場合の「カード利用日」（代金の引落し基準日）は、旅行代金の追加・減額等がない限り契約成立日とします。
When a communication contract is concluded, the “card usage date” (the date on which payment is debited) will be the contract conclusion date, unless there are any additions or reductions to the travel price. - コースに含まれない交通費、飲食代、通信費、自由行動中の諸費用、および各自で加入される旅行保険料などは旅行代金に含まれません。
The tour price does not include transportation costs, food and beverage expenses, communication costs, miscellaneous expenses during free time, or travel insurance premiums purchased individually. - 著しい経済情勢の変化等により、公示された運賃・料金が通常想定される程度を大幅に超えて改定されたときは、その差額分だけ旅行代金を増額または減額することがあります。増額する場合は旅行出発日の前日から起算してさかのぼって15日前までに通知します。この場合、お客様は取消料を支払うことなく契約を解除できます。
If the announced fares and charges are revised by a significant amount beyond what is normally expected due to substantial changes in economic conditions, the tour price may be increased or decreased by the difference. In the case of an increase, we will notify you at least 15 days prior to the departure date. In this case, you may cancel the contract without paying a cancellation fee. - 利用人員（参加人数）の変更により旅行代金が異なる旨を事前に明記していた場合、当社の責によらない事由で人員が変更となったときは、旅行代金を変更します。
If it was stated in advance that the tour price would change depending on the number of participants, and the number of participants changes due to reasons beyond our control, we will change the tour price.
7.お客様の交替（名義変更）
- お客様は、当社の承諾を得て、契約上の地位を第三者に譲渡することができます。この場合、所定の用紙に記入の上、交替手数料をお支払いいただきます。
Customers may, with our consent, transfer their contractual rights to a third party. In this case, they must complete the prescribed form and pay a transfer fee. - 利用する運送・宿泊機関等の規則により名義変更が認められない場合は、交替をお断りすることがあります。この場合は、既存の契約を解除（所定の取消料が発生）し、新たな旅行者と新規に契約を締結していただきます。
If the change of name is not permitted by the rules of the transportation or accommodation providers used, we may refuse the change. In this case, the existing contract will be terminated (a prescribed cancellation fee will apply), and a new contract will be concluded with the new traveler.
8.お客様による旅行契約の解除
- お客様は、企画書面に記載された所定の企画料金または取消料を支払うことにより、いつでも契約を解除できます。解除期日は、当社の営業日・営業時間内に申し出て、当社が確認したときを基準とします。
Customers may terminate the contract at any time by paying the prescribed planning fee or cancellation fee stated in the project proposal. The termination date will be determined based on the date the customer makes the request during our business hours and we confirm it.- お客様の任意で旅行サービスの一部を利用しなかった、または途中離脱された場合は権利放棄とみなし、一切の払い戻しはいたしません。
If a customer chooses not to use any part of the travel services or withdraws from the tour midway, this will be considered a waiver of their rights, and no refunds will be given. - コースや出発日の変更、当社の責任とならないローン審査不通過等の場合も、所定の取消料の対象となります。
Changes to the course or departure date, or failure to pass loan application (which is not our responsibility), will also be subject to the prescribed cancellation fee.
- お客様の任意で旅行サービスの一部を利用しなかった、または途中離脱された場合は権利放棄とみなし、一切の払い戻しはいたしません。
- お客様は、次に掲げる事由がある場合は、旅行開始前に取消料を支払うことなく契約を解除できます。
Customers may cancel the contract before the start of the trip without paying a cancellation fee if any of the following circumstances apply:- 契約内容に重要な変更（日程、目的地、運送機関の会社や等級の低下、宿泊機関の変更等）が行われたとき。
When there are significant changes to the contract details (such as changes in dates, destination, transportation company or class, or accommodation). - 旅行代金が増額されたとき（お客様の求めによる変更を除く）。
When the tour price is increased (excluding changes requested by the customer). - 天災地変、戦乱、官公署の命令、運送・宿泊機関のサービス提供中止等により、安全かつ円滑な旅行の実施が不可能となったか、そのおそれが極めて大きいとき。
When it becomes impossible or there is a very high risk that travel will be conducted safely and smoothly due to natural disasters, war, government orders, suspension of services by transportation or accommodation providers, etc. - 当社が期日までに確定書面を交付しなかったとき、または当社の責により当初の日程通りの実施が不可能となったとき。
If our company fails to issue the confirmation document by the deadline, or if it becomes impossible to carry out the work as originally scheduled due to our fault.
- 契約内容に重要な変更（日程、目的地、運送機関の会社や等級の低下、宿泊機関の変更等）が行われたとき。
9.当社による旅行契約の解除
- お客様が期日までに旅行代金を支払わないときは、期日の翌日にお客様が契約を解除したものとみなし、取消料と同額の違約料を申し受けます。
If the customer fails to pay the travel fee by the due date, the customer will be deemed to have canceled the contract on the day following the due date, and a penalty fee equal to the cancellation fee will be charged. - 通信契約を締結した場合であって、お客様の有するクレジットカードが無効になる等、お客様が旅行代金等に係る債務の一部又は全部を提携会社のカード会員規約に従って決済できなくなったときも、当社は契約を解除することがあります。
If a communication contract is concluded, and the customer’s credit card becomes invalid or for any other reason that prevents the customer from settling part or all of the debt related to the travel expenses in accordance with the affiliated company’s cardholder agreement, we may terminate the contract. - お客様が病気等で旅行に耐えられないと認められるとき、他のお客様に迷惑を及ぼすおそれがあるとき、合理的な範囲を超える負担を求めたとき、または反社会的勢力に該当すると判明したときは、当社は契約を解除することがあります。
We may terminate the contract if we determine that a customer is unable to travel due to illness or other reasons, if they may cause inconvenience to other customers, if they request burdens that exceed a reasonable scope, or if they are found to be affiliated with anti-social forces. - 旅行開始後であっても、お客様が病気等により継続に耐えられないとき、添乗員等の指示に従わず団体行動の規律を乱したとき、または天災地変等により旅行の継続が不可能となったときは、当社は契約の一部を解除することがあります。この場合、いまだ提供を受けていないサービスに係る費用から、取消料や違約料等の実費実損を差し引いた残額をお客様に払い戻します。なお、出発地に戻るための手配をお客様の求めに応じて行いますが、これに要する費用は全額お客様の負担となります。
Even after the start of the trip, if the customer is unable to continue due to illness or other reasons, if they disrupt group activities by failing to follow the instructions of the tour guide or other staff, or if the trip becomes impossible to continue due to natural disasters or other unforeseen circumstances, we may terminate part of the contract. In this case, we will refund the customer the amount remaining after deducting actual expenses such as cancellation fees and penalties from the cost of services not yet provided. We will also make arrangements for the customer to return to the departure point upon request, but the customer will be responsible for all associated costs.
10.旅行代金の払い戻し時期
- 当社は、代金の減額または契約の解除によりお客様に対し払い戻すべき金額が生じたときは、以下の期限内にお客様に対し当該金額を払い戻します。
If we are obligated to refund an amount to the customer due to a reduction in price or cancellation of the contract, we will refund that amount to the customer within the following timeframe.- 旅行開始前の解除：解除の翌日から起算して7日以内
Cancellation before the start of travel: Within 7 days from the day following the cancellation. - 旅行代金の減額・旅行開始後の解除：契約書面に記載した旅行終了日の翌日から起算して30日以内
Reduction of travel price / Cancellation after the start of the trip: Within 30 days from the day following the end date of the trip as stated in the contract.
- 旅行開始前の解除：解除の翌日から起算して7日以内
- 通信契約を締結した場合であって、お客様に払い戻すべき金額が生じたときは、提携会社のカード会員規約に従って払い戻します。この場合の払い戻しを行うべき日（カード利用日）は、旅行開始前の解除にあっては解除の翌日から起算して7日以内、旅行代金の減額または旅行開始後の解除にあっては旅行終了日の翌日から起算して30日以内とします。
If a communication contract is concluded and there is an amount to be refunded to the customer, the refund will be made in accordance with the cardholder agreement of the affiliated company. In this case, the date on which the refund should be made (card usage date) is within 7 days from the day following the cancellation if the cancellation occurs before the start of the trip, and within 30 days from the day following the end of the trip if the travel price is reduced or the trip is canceled after the start of the trip.
11.添乗・旅程管理サービス
- 添乗員の同行の有無は契約書面に明示します。添乗員の業務時間は、原則として8時から20時までとし、旅行を安全かつ円滑に実施するために必要な業務を行います。
Whether or not a tour guide will accompany the group will be clearly stated in the contract. The tour guide’s working hours will generally be from 8:00 to 20:00, and they will perform the necessary duties to ensure the safe and smooth execution of the trip. - 添乗員（または現地係員）が同行しないコースにおいては、お客様がサービスを受けるためのクーポン券等をお渡ししますので、ご旅行中の手続きはお客様ご自身で行っていただきます。悪天候等による変更の手続きも同様にお客様ご自身で行っていただきます。
For tours without a tour guide (or local representative), you will be provided with coupons or vouchers for services, and you will be responsible for handling all procedures during your trip. Similarly, you will be responsible for handling any changes due to bad weather or other unforeseen circumstances.
12.当社の責任および免責事項
- 当社は、当社または手配代行者が故意または過失によりお客様に損害を与えた場合は、その損害を賠償します（損害発生の翌日から起算して2年以内に当社に通知があった場合に限ります）。
We will compensate you for any damages caused to you by our willful misconduct or negligence, whether caused by us or our agents (provided that we are notified within two years from the day following the occurrence of the damage). - お客様が、天災地変、戦乱、暴動、運送・宿泊機関のサービス提供中止・遅延・スケジュール変更、官公署の命令、自由行動中の事故、食中毒、盗難など、当社または手配代行者の関与し得ない事由により損害を被ったときは、当社はその責任を負いません。
We shall not be liable for any damages incurred by customers due to reasons beyond our control or the control of our agents, including but not limited to natural disasters, wars, riots, suspension, delays, or schedule changes of transportation or accommodation services, government orders, accidents during free time, food poisoning, theft, etc. - 手荷物について生じた損害については、損害発生の翌日から起算して14日以内に通知があった場合に限り、当社の過失がある場合はお一人様最高15万円を限度（1個または1対につき最高10万円限度、当社に故意または重大な過失がある場合を除く）として賠償します。
Regarding damage to baggage, compensation will be provided only if notification is received within 14 days from the day following the occurrence of the damage, and only if the damage is due to our negligence, up to a maximum of 150,000 yen per person (maximum of 100,000 yen per piece or pair, excluding cases where we acted with intent or gross negligence).
13.特別補償
- 当社は、前項に基づく当社の損害賠償責任が生じるか否かを問わず、お客様が本旅行参加中に、急激かつ偶然な外来の事故によって生命、身体または手荷物に被った一定の損害について、旅行業約款特別補償規程により、以下の補償金または見舞金を支払います。
Regardless of whether or not our liability for damages arises under the preceding paragraph, we will pay the following compensation or consolation money in accordance with the Special Compensation Provisions of the Travel Agency Terms and Conditions for certain damages to your life, body, or baggage caused by a sudden and accidental external event while you are participating in this tour.- 死亡補償金：1,500万円
Death benefit: 15 million yen - 入院見舞金：2万円～20万円（入院日数による）
Hospitalization allowance: 20,000 to 200,000 yen (depending on the number of days hospitalized) - 通院見舞金：1万円～5万円（通院3日以上）
Outpatient medical care allowance: 10,000 to 50,000 yen (for outpatient visits of 3 days or more) - 携行品損害補償金：お一人様につき最高15万円限度（1個または1対あたり10万円限度。ただし現金、貴重品、クレジットカード、電子データ等は補償対象外）。
Personal belongings damage compensation: Maximum of 150,000 yen per person (100,000 yen per item or pair; however, cash, valuables, credit cards, electronic data, etc. are not covered).
- 死亡補償金：1,500万円
- 自由行動中の危険な運動（山岳登はん、スカイダイビング等）による事故、または故意、酒酔い運転、疾病などによる損害および地震、噴火または津波そしてその事由に随伴して生じた事故・秩序の混乱に基づいて生じた事故によるものであるときは、補償金支払いの対象外となります。
Compensation will not be paid for accidents resulting from dangerous activities during free time (such as mountain climbing or skydiving), damages caused by intentional acts, drunk driving, illness, etc., or accidents resulting from earthquakes, volcanic eruptions, or tsunamis, or accidents and disorder caused in connection with these events.
14.旅程保証（変更補償金）
- 契約書面（または確定書面）に記載された重要な内容に変更（日程の変更、目的地の変更、運送機関の等級低下、宿泊機関の変更等）が生じた場合、当社は変更の内容に応じて、旅行代金の1.0%～3.0%の変更補償金を旅行終了日の翌日から起算して30日以内に支払います。ただし、一旅行契約あたりの上限は旅行代金の15%とし、補償金の総額が1,000円未満であるときは支払いません。
If any significant changes occur to the terms and conditions stated in the contract (or confirmation document), such as changes to the itinerary, destination, downgrade of transportation class, or change of accommodation, we will pay compensation ranging from 1.0% to 3.0% of the tour price within 30 days from the day following the end of the trip, depending on the nature of the change. However, the maximum compensation per tour contract is 15% of the tour price, and no payment will be made if the total compensation amount is less than 1,000 yen. - ただし、次の事由による変更の場合は変更補償金を支払いません（オーバーブッキングによる変更を除く）。
However, no compensation will be paid for changes due to the following reasons (excluding changes due to overbooking).- 天災地変

War and riots - 官公署の命令
Orders from government agencies - 欠航・不通・休業等の旅行サービス提供の中止
Cancellation of travel services such as flight cancellations, service disruptions, and business closures. - 遅延・スケジュール変更等の当初の運行計画によらない運送サービスの提供
Providing transportation services that do not conform to the original operating plan, such as delays or schedule changes. - お客様の生命・身体の安全確保のため必要な措置
Measures necessary to ensure the safety of our customers’ lives and bodies.

- 最終旅行日程表（確定書面）が交付された場合には、「契約書面」とあるのを「最終旅行日程表」と読み替えたうえで、この表を適用します。この場合において、契約書面の記載内容と最終旅行日程表の記載内容との間又は最終旅行日程表の記載内容と実際に提供された旅行サービスの内容との間に変更が生じたときは、それぞれの変更につき1件として取り扱います。
When the final itinerary (confirmation document) is issued, this table shall apply, with “contract document” being read as “final itinerary.” In this case, if there are any changes between the contents of the contract document and the contents of the final itinerary, or between the contents of the final itinerary and the travel services actually provided, each change shall be treated as a separate item.
15.お客様の責任・その他免責規定
- お客様の故意、過失、法令・公序良俗に反する行為により当社が損害を被ったときは、お客様は損害を賠償しなければなりません。
If our company suffers damage due to the customer’s intentional acts, negligence, or actions that violate laws, regulations, or public order and morals, the customer must compensate us for the damage. - 提供された旅行サービスが契約内容と異なると認識したときは、旅行地において速やかに当社またはサービス提供者にその旨を申し出なければなりません。
If you realize that the travel services provided differ from those specified in the contract, you must promptly notify our company or the service provider at your travel destination. - 土産物店等での購入は、お客様ご自身の責任で行ってください。また、当社以外の者が企画・実施するオプショナルツアーに参加された場合、当社は特別補償規程のみを適用し、それ以外の責任は負いません。
Purchases made at souvenir shops, etc., are the responsibility of the customer. Furthermore, if you participate in an optional tour planned and conducted by a party other than our company, we will only apply our special compensation regulations and will not assume any other responsibility. - 航空会社のマイレージサービス等の積算手続き、および利用航空会社の変更に伴うマイル不積算のトラブルについて、当社は一切の責任を負いません。
We assume no responsibility whatsoever for any issues related to the accrual procedures of airline mileage services, or for any problems arising from changes in the airline used. - 当社は、いかなる場合も旅行の再実施はいたしません。

17. 細則
本書面（取引条件書）に定めのない事項、及び本書面の記載内容と当社旅行業約款との間に齟齬（食い違い）が生じた事項については、当社の「旅行業約款（受注型企画旅行契約の部）」の規定によります。
Matters not stipulated in this document (Terms and Conditions of Transaction), and matters in which there are discrepancies between the contents of this document and our travel agency terms and conditions, shall be governed by the provisions of our “Travel Agency Terms and Conditions (Section on Customized Package Tour Contracts).”
